These terms and conditions govern your purchase of goods from JMA Global Ventures (hereinafter referred to as “JMA”) through its online store www.jmagv.com (hereinafter referred to as “our Website”). Please read these Terms and Conditions carefully.

Definitions In these terms and conditions :-

• “Acknowledgement” means our written acknowledgement of receipt of your Request Form;
• “Agreement” means these terms and conditions together with your Request and the Sales Confirmation;
• “Customer” and “you” means the person , firm or corporation purchasing the goods from JMAGV;
• “Goods” means any product listed on our Website;
• “Invoice” means the invoice issued by JMA Global Ventures to the Customer showing the price of your Goods which is proof of purchase;
• “JMAGV” means JMA Global Ventures;
• “Request Form” means the electronic request form on our Website;
• “Sales Confirmation” means the written confirmation of your Request and confirmation of your Request by JMAGV;
• “Sales Confirmation Number” means your Goods confirmation number issued by JMAGV to you upon our acceptance of your Request; and
• “We” and “us” means JMA Global Ventures.

Except to the extent that the subject matter or context may otherwise require in these terms and conditions, (i) expressions including the singular may indicate the plural and vice versa, (ii) expressions indicating any particular gender may indicate all other genders and (iii) expressions indicating bodies corporate may also indicate natural persons and vice versa.

Electronic Communications

When you visit our Website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on our Website. You agree that all agreement, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communication be in writing.

No Sales to Persons under 18 years of age

This Website is not intended for children. We will not knowingly accept any information or offers to purchase from children. If you are under 18, you may use our website only with the involvement of a parent/guardian.

Your Account

Submitting Your Request

You may submit a Request by filing in the Request Form on our Website. You must use the Request Form from our Website or for international orders via email to sales.enquiry@jmagv.com. We will not process Requests placed in any other way.

Upon receipt of your Request, we will issue you with the Acknowledgement via e-mail confirming that we have received your Request and that we will process your Request. Thereafter we will follow up by sending you an email with your Sales Confirmation Number. This means that your Request has been accepted by us as a firm order for the Goods selected and specified in the Request Form.

All Requests placed through our Website are subject to our acceptance in the manner as described above. We may or may not accept your Request at our discretion.

Information on our Website constitutes an invitation to treat. Nothing on our Website and no such information should be construed as constituting an offer by us to supply any Goods. By submitting a Request, you are making an offer to us to purchase the Goods that you have selected on our Website and you are agreeing to be bound by these terms and conditions. The offer will only be accepted upon the issuance of the Sales Confirmation bearing the Sales Confirmation Number.

If we cannot accept your Request, we will notify you accordingly by telephone (or such other means of communication as we deem fit).

Withdrawing Your Request

You may withdraw your Request before we issue you the Sales Confirmation Number. However, if you withdraw your Request after we have issued you the Sales Confirmation Number, we reserve the right to levy a cancellation charge equal to S$20.

Price of Goods

The price payable by you for the Goods will be indicated on your Sales Confirmation and is inclusive of any goods and services tax (GST) and any other tax, charges or customs duties imposed on the Goods, but does not include delivery charges. All our prices are quoted in Singapore Dollars (SGD) and American Dollars (USD).

In the unlikely event that a sales price stated on our Website is incorrect for any reason, then the following applies :

• If the Goods’ correct price is lower than our stated price, we charge the lower amount.
• If the Goods’ correct price is higher than our stated price, your Request will be rejected and we will endeavor to notify you accordingly.

Payment Terms

All payments must be made in American dollars if via Paypal. If you are paying by Money order or Personal cheque, we accept Singapore Dollars (SGD)

We accept most major credit cards. If you are paying by credit card, you must supply your credit card details when you submit your Request. Your credit card billing address must be in Singapore. If you are paying by credit card, your credit card will be charged for the full price of the Goods upon our issue of your Sales Confirmation.

If you are paying by a money order or personal cheque, your money order or personal cheque must be mailed, received by us and cleared before the Goods are delivered to you. All money orders or personal cheques must be made payable to “JMA GLOBAL VENTURES LLP” and sent to the following address:

Ensure you attach a copy of the system generated invoice together with your payment.

An Invoice will be delivered together with your Goods. Your Invoice will be proof of purchase. These payment terms are subject to change without notice and at our sole discretion.

The online payment is via the Paypal Payment Gateway. Your information is secured by the Secure Sockets Layer (SSL) software, which encrypts information you input. For more information, please refer to the PayPal website at http://www.paypal.com

Delivery of Goods

The Customer will bear all delivery/ freight charges unless otherwise stated. This will be reflected in the Sales Confirmation.

Unless otherwise agreed by us, we will deliver your Goods to the address indicated on your Request Form between the hours of 9am and 7pm Mondays to Fridays. We do not make deliveries on weekends and public holidays.

If no one is available to take delivery of your Goods at the arranged time and date for delivery, our carrier will leave a card requesting you to telephone and arrange a suitable time and date for delivery. We reserve the right in those circumstances to charge a separate additional delivery fee.

Although we will use reasonable endeavors to deliver your Goods to you within 7 days of the date of issue of your Sales Confirmation, we do not guarantee that we will deliver within this time frame.

Product Description

We attempt to be as accurate as possible. However, jma.com does not warrant that product descriptions or other content of our Website is accurate, complete, reliable, current or error-free. If a product offered by jma.com itself is not as described, your sole remedy is to return it in its unused condition with undamaged packaging.

Title; Risk of Loss

Title to, and risk of loss in or damage to the Goods shall pass to you upon our receipt of full payment of the price of your Goods.

Product Warranty

Goods are supplied and sold on “as is where is” basis.

Should a product become defective within one year of purchase, follow the procedure below:

Please email our Customer Service Department at customerservice@jmagv.com with the following information, requesting an exchange:

1. Order number
2. Product number and/or name
3. Reason for return

We will reply via email with a return address and a Return Material Authorization number (RMA#), which MUST be issued prior to JMA accepting any returns. Packages without an RMA number cannot be accepted at our warehouse, or any manufacturer's warehouse.

Include the original packing slip, copy of the receipt, exchange or refund instructions and the RMA number.

The RMA number should also be noted on the shipping label when returning an item - in the following form: Attention - Returns (RMA # )

Please make sure that the package is securely wrapped. Again, please note that we can only refund shipping costs if the return is a result of our error, otherwise, shipping costs are your responsibility.

Return Policy

If you are not totally satisfied with any Goods purchased from us, you may return it to us and exchange the Goods for another item of equal or higher value and paying any difference in the price provided that you contact us within 3 days of delivery of the Goods to you. You can contact us by telephone between 9am and 6pm Mondays to Fridays to make arrangements in respect of the aforesaid exchange of Goods. All Goods to be exchanged must be returned in their original packaging together with the Invoice.

All tags and labels must not have been removed form Goods returned. If you choose to return the Goods by post, you will be responsible for any damage and/or loss.

Exchanges may be available while stocks last. All returns and exchanges of Goods are subject to approval of JMA and may not be immediate. Please follow the same procedure as Product Warranty (above) and email customerservice@jmagv.com before returning any goods.

Limitation of Liability

These terms and conditions set out the full extent of our obligations and liabilities in respect of the supply of the Goods and performance of any service in relation thereto, and there are no other warranties, conditions or terms that are binding on us except as expressly stated herein. Any warranty, conditions or term concerning the Goods which might otherwise be implied or incorporated in these terms and conditions by statute, common law or otherwise is hereby expressly excluded.

Subject to the foregoing, we shall not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss of damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. Our maximum aggregate liability hereunder whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the price of the Goods paid by you to us.

Privacy

By placing your Request, you agree that we may store, process, disclose and use data collected from you for the purpose of processing your Request and delivering your Goods.

Variation

We reserve the right to amend, vary and change these terms and conditions at our discretion at any time without notice to you. Your continued use of our Website and submitting of any Request to us shall be construed as your acceptance of any such amendments, variations and changes to these terms and conditions.

Entire Agreement

These terms and conditions together with your Request and the Sales Confirmation constitute the entire Agreement between us and you in relation to your purchase of the Goods and supersede any and all statements or other agreements (oral or written) between you and us.

Disclaimers

We will not be liable for any loss or damage suffered or incurred by you arising from our delay in fulfilling or failure to fulfill or otherwise discharge any of our obligations hereunder to the extent that such delay or failure is caused is caused by any circumstance beyond our reasonable control. The invalidity or unenforceability of any provision hereof shall not adversely affect the validity or enforceability of the remaining provisions. Neither our failure nor yours to enforce any provision hereof constitutes a waiver of such provision. Such failure shall in no way affect the right later to enforce the same.

Governing Law

These terms and conditions shall be governed by the law of Singapore. Both we and you irrevocably and unconditionally submit to the jurisdiction of the courts of Singapore.
